Josie specialises in estate, trust and probate disputes. She has a wide range of experience both bringing and defending claims including claims under the Inheritance (Provision for Family and Dependants) Act 1975, Will validity disputes, promissory and proprietary estoppel, constructive and resulting trusts, executor and trustee disputes and applications to remove executors, construction and rectification claims and claims involving lifetime financial abuse and/or misconduct by attorneys.
Josie acts on behalf of both private clients and national charities, working closely alongside colleagues in both our Tax & Succession team and Charity Probate team to provide a comprehensive and seamless service to clients. As well as acting in disputes, Josie also provides ad hoc advice to charity clients on a range of matters, such as ex gratia (moral) payment requests by disappointed beneficiaries, and assists with providing training sessions to in-house legacy teams.
Whilst the majority of Josie’s cases are successfully resolved without the need for a contested court hearing, which is the preference of many clients, Josie also has experience of running disputes all the way to trial. Josie is therefore well-placed to support her clients from the very early stages of a potential dispute, at a mediation or with other forms of Alternative Dispute Resolution and all the way through to a contested trial, if required by the particular case.
Josie is a keen gardener with a particular passion for growing her own vegetables and creating pollinator and wildlife-friendly habitats in her local area, as part of a group of local volunteers. Josie also regularly performs as a member of a community choir and enjoys running and outdoor swimming. Josie’s latest challenge is to train for a 25km (very hilly!) trail run on the Dorset coast.
Work highlights
- Acting for a charity beneficiary in the defence of a proprietary estoppel claim, constructive trust claim and claim under the Inheritance (Provision for Family and Dependants) Act 1975, obtaining the withdrawal of one of the claims for lack of merit and early settlement of the remaining claims.
- Acting for an adult child in a successful claim for reasonable financial provision from the estate of their late father under the Inheritance (Provision for Family and Dependants) Act 1975. The claim was decided by the Court following a trial and the claimant was awarded a lump sum from the father’s estate and payment of their costs.
- Acting for one of five defendants to a Will validity challenge, involving a number of connected farms, a disputed Deed of Gift and allegations of lifetime financial abuse of the Deceased. The claim was successfully settled pre-trial.
