It’s not all about cleaning up after an accident.

Navigating the rules and regulations that apply to your business is a critical consideration and frequent changes to legislation and guidance, for example health and safety regulations, only make that task harder.

Companies managing an external risk may be left with little reassurance that they are correctly applying the law given the guidance which has been provided; and so risk management will be at the centre of your commercial strategy.

Now more than ever, organisations of all shapes and sizes – and in all industries,  can benefit from the support of a team of trusted advisors, allowing them to move forward with certainty and plan for their future.

Why choose Foot Anstey?

We understand from experience that prevention is indeed better than cure.

We can work with you to help you evaluate the risks facing your business – whether that risk relates to Covid-19 (and the challenge of securing ‘Covid secure’ status) or not.

We understand that businesses will be planning for the future and ‘learning to live with’ Covid -19.  We can be with you every step of the way to ensure you are aware of the risks and responsibilities; supporting you in navigating the regulatory minefield using our three-stage process as below – Anticipate, Prevent, Cure.

We’ll help you anticipate changes before they happen, to embed safe management practices that proactively insulate you from risk, and to quickly adapt to requirements should you find yourself responding to a regulatory investigation or facing enforcement action.

As part of the cycle, we can work with you to undertake Root Cause Analysis, carry out  your own internal regulatory investigation and ensure that lessons are learned across the organization to reduce the risk of a repeat incident.

Anticipate

We horizon scan to spot legal developments that may affect your industry, review the latest HSE Guidance to ensure you can plan for the future based on the latest information.

Prevent

To help ensure that you are managing your business safely, we provide a “fresh pair of eyes” to Boards, Group and General Counsel and management teams. Working with H&S consultants to provide a legal analysis of regulatory risks, we help to manage your risk exposure and deliver a culture of proactive compliance and risk awareness. Our experience of carrying out due diligence in preparation for acquisitions enables us to identify significant risks involved in acquiring businesses too.

Cure

We recognize that sometimes the worst happens. If an adverse incident occurs, we can support you on a ‘drop and go’ basis, making sure that we are at your premises when the regulatory agency begins their work. We provide you with strategic advice in readiness for any recorded regulatory interview; and have years of experience of successfully defending businesses in the Magistrates and Crown Courts across England and Wales.

Our people

Our Health and Safety team draw from a depth of experience that includes both risk advice and acting for prosecuting authorities.  We have a strong track record of helping organisations align management of health and safety with their overall risk management programme, and to provide Board oversight and assurance.

The team also has significant advocacy experience in the Magistrates’ Court, Crown Court and Coroner’s Courts and of representing clients at Inquests.  Our lawyers have significant experience of prosecuting health and safety cases for the HSE, whichenables us to understand their approach.

We understand both sides of the argument, and are well placed to translate that into realistic, actionable advice.
