We would be delighted if you could join us for the latest Lenders' Litigation Forum, which will now be taking place online due to additional demand to enable those of you from further afield to join the session.

We are delighted to say we will be joined by Francesca Mitchell and Tim Matthewson of Wilberforce Chambers to discuss - Beyond Quincecare: where next for claims against banks & payment services providers?

The session will be broken into three bitesize conversations:

  1. Update on the Market: Based on our instructions, a short reflection on the impact the current rate rises and uncertainty is having on all strata of banks, lenders and finance houses.
  2. Key Focus: Economic Stress, Forbearance and the Consumer Duty: Now the Consumer Duty has come into force and as the Mortgage Charter leads to revisiting of forbearance options, we will discuss with our regulatory specialist, Laura Autiero: how impactful is the regulatory environment for banks looking at forbearance, recoveries and/or enforcement action?
  3. Legal Update: Beyond Quincecare: where next for claims against banks & payment services providers?

Whilst the Supreme Court's decision in Philipp v Barclays has limited the impact of the so-called Quincecare duty for certain customers, it is important to note that not all questions around the application of Quincecare or payment disputes can be provided in a single judgement. Further, one cannot ignore other decisions and the developing regulatory environment. As such, with our guests, we'll discuss those… areas of grey which banks and PSPs should be mindful of.
