Cohabitees’ financial dispute 

The parties had cohabited for a long period, but never married. The man was a builder/developer who alleged that, not withstanding the fact that various properties totalling £3m were in joint names, they were in fact held in trust for him. This meant that apart from a payment based on financial contribution of between £50,000 and £70,000 the portfolio was all his.

Our client (the woman), argued that it had always been a joint venture and she was entitled to half of the net value of the portfolio.   The matter went to trial. The judge found for the woman and in view of the man’s approach, also ordered indemnity costs and additional interest in light of an early offer to settle the case on a 40/60 basis in favour of the man.
