Wellcome Wolfson Centre for Translational Medicine at the Royal Devon & Exeter Hospital Wonford for the Royal Devon & Exeter NHS Foundation Trust

This major medical research and development project is a joint collaboration between our client, the NHS Foundation Trust, and the University of Exeter, with the added support of various other institutions including the Wellcome Trust and Wolfson Foundation. The envisaged project cost is £19.75 million.

The project, which is intended to be procured as one of the first major projects under the Department of Health’s Procure 21+ framework, requires complex contractual arrangements governing the relationship between the two development partners and reflecting a major development on the extremely busy site of one of the largest NHS hospitals in the South West. We are advising on the development agreement, the building contract and the respective professional appointments. We are also dealing with the grant of a long lease in favour of the University for the new facility.


Phase 1 of a major development site in Plymouth for Mount Wise (Guernsey) Ltd

This landmark site in Devonport, Plymouth, is being developed on the site of an old MOD/Admiralty facility as a mixed-use residential and commercial development incorporating a boutique hotel. We have advised the client in relation to site acquisition and planning issues, the securing of necessary finance and other construction documentation.

We worked intensively for a period of four months on the negotiation of the £14 million building contract, which required lengthy negotiation with both the appointed contractor and the funder against tight deadlines. In order to secure an early start on site, we were responsible for the drafting and negotiation of an appropriate letter of intent to reflect the parties’ varying interests. Construction works have now started on what is one of the principal development sites in the South West.


The new Five Islands School, St Mary’s, Isles of Scilly for Kier Western and the Council of the Isles of Scilly

The Five Islands School is the first federated school in the UK providing primary and secondary education at five sites across the Isles of Scilly. The school was given funding of £13 million for the development. The works were procured by the local education authority, the Council of the Isles of Scilly, and Kier Western was the appointed contractor. This was the largest single procurement ever undertaken by the Council.

We were responsible for preparing the engineering and construction contract documents. Due to the unique nature of building a major new school in an island community some 30 miles off the UK mainland, the appropriate allocation of risk between the employer and contractor needed extremely careful and detailed drafting. We had to work to a very tight deadline and completed the documents within days of the planned contract signing on St Mary’s.
