Consumer Credit

The Consumer Credit Act 2006 has introduced significant changes to an already complex area of the law over recent years. Specialist knowledge of this area is crucial to ensure that you operate within, and in compliance with, the complex legislation governing the provision of credit in the UK.

We have experience of advising a wide range of clients on the impact of consumer credit legislation on the operation of their business. They have advised private banks, investment banks, motor finance providers and retailers and many other credit providers and intermediaries on a variety of consumer credit issues, including:

  • drafting compliant loan and credit card agreements
  • providing procedural advice on how to enter into credit agreements in accordance with the relevant legislation
  • perimeter guidance on whether activities are caught by the legislation or not;
  • advice on consumer credit advertising rules
  • advice on licensing issues
  • dealing with the OFT and Trading Standards when accused of potential breaches of the legislation

We also act for two national finance companies in relation to the enforcement of their leasing, loan, hire purchase and asset finance agreements.  This includes recovering assets, dealing with disputed debts, pursuing money claims and investigating frauds.
