Financial Services Update - Unfair Terms In Client Agreements

As part of the TCF project FSA are increasingly looking at whether terms between firms and their customers are “fair” according to the Unfair Terms in Consumer Contracts Regulations 1999 (the Regulations).

All firms therefore need to be aware of the Regulations when creating a new client agreement or reviewing an old one or entering into any other contract with a customer. This bulletin considers the main requirements of the Regulations, examines FSA’s policy in enforcing them and provides practical guidance on how to avoid falling foul of the Regulations.
