Compliance Issues

For charities, the trade-off for tax advantages is the need to comply with the extensive limitations which the law places upon them. In order to avoid criticism or worse from the Charity Commission, and damage to their hard-won reputations, charities often need advice on how the law affects their activities or plans. We have significant experience of helping charities to avoid falling foul of the law.

Please see our guide to the law on public benefit under the Charities Act 2006

Case studies

  1. Advising a leading south west independent school on proposed amendments to its charitable objects to facilitate compliance with the rules on public benefit as brought in by the Charities Act 2006.
  2. Advising a national charity on its ability to make an “ex-gratia” payment to an employee, i.e. a payment which it is not under a legal obligation to make.
  3. Assisting a charity with advice on its ability to engage one of its trustees to provide services to the charity.
  4. Advising a number of charities on the impact of the Companies Act 2006 on how charity trustees deal with conflicts of interest.
  5. Advising a significant regional charity in conjunction with its accountants as to how the acquisition of a significant asset, costing several million pounds, could be structured and financed in a VAT-efficient manner whilst still complying with charity law requirements.
